src="images/local333.jpg" style="border: solid 1px #000000; margin-right: 10px;" /></td> </tr> </table> We are pleased to announce that Local 333 prevailed in its improper practice petition challenging New York City Department of Transportation s ( DOT ) unilateral creation and implementation with a sick leave policy, SMS Alert No. 94. SMS Alert No. 94 altered the terms and conditions of employment by preventing employees absent from work for three or more days from returning to work unless they provided a doctor s letter stating that they were fit for duty. This policy deviated from the prior sick leave policy in that the old policy only required employees to provide a doctor s letter confirming that the employee was sick. <br /><br /> After Local 333 learned of the DOT s intention to implement SMS Alert No. 94, President Harrigan and Secretary-Treasurer Brandon demanded that DOT rescind the policy and that the DOT bargain in good faith with respect to any changes to sick leave policy. DOT refused to bargain in good faith and implemented SMS No. 94. <br /><br /> As a result of DOT s refusal to bargain in good faith, President Harrigan and Secretary-Treasurer Brandon filed an improper practice petition with the New York City Office of Collective Bargaining ( OCB ) alleging that DOT unilaterally altered the terms and conditions of employment and that it also refused to bargain in good faith. <br /><br /> After hearing the Local 333 s arguments, OCB found that the DOT unilaterally altered the terms and conditions of employment and that it failed to bargain in good faith. Moreover, OCB ordered the DOT to post notices at the worksite detailing its improper practices and informing Local 333 of this case.
